My father has passed away! My mother is in the fifth stage of Parkinson’s. She’s unable to speak, move, or do anything other than express distress. She’s imprisoned within her own body, a situation some of you might grasp. I was informed by the assisted living center, where my parents had resided for a number of years, about my father’s passing. The sole purpose for contacting me was the outstanding bills. Their priority was financial, showing no concern for my father’s death, focusing solely on receiving their payment. This initial issue of unpaid bills is highly relevant to the forthcoming praise. With the bills remaining unpaid, my father’s last will transferred everything to my mother. Nevertheless, she’s unable to communicate her wishes or designate someone to manage her affairs. Luckily, I had a prior connection with my mother’s lawyer, enabling me to seek his advice. However, he was no longer in active practice, limiting his ability to assist with the full scope of legal requirements that surfaced as I began exploring the necessary steps to care for my mother. For clarification, I am the son, the oldest among my siblings.
The lawyer directed me to an organization known as OurSeniors. This referral proved to be a stroke of luck, as I was unaware of the extent of their future support for my mother and me. I will strive to concisely convey the magnitude of OurSeniors’ assistance, both past and present, as they have been an incredible blessing. The initial action taken by the OurSeniors Team was connecting me with the law firm of Chiumento, Dwyer, Hertel and Grant. After explaining the situation, they assigned a guardianship lawyer to handle the preparation of required documents, secure an emergency guardianship for my mother, and later facilitate the acquisition of permanent guardianship.
Next, I tried to find out about my mom’s condition, her medical care, overall health, and general well-being. I was completely lost about where to begin or who to speak with since the facility she was staying in was solely interested in financial gain. This should serve as an early indication of a problem with your relatives’ health, your partner, a sibling, or possibly even your husband or wife. The reason I mention this is because it is crucial to fully comprehend the experiences of your relatives or those you care for. In my particular circumstance, I came to the realization that things were progressing quite negatively. My mom had a strong desire to reside in this specific assisted living facility due to the fact that both my grandfather and grandmother were also residents there. At one time, this place was a perfect assisted living community, but that is no longer accurate. It was purchased by a new owner, and the designation of “Not for Profit” is no longer applicable. I was accompanied by the OurSeniors Team, and I was extremely grateful for their presence. The situation I witnessed stirred up a lot of emotion in me. If they had not been there to support me, I’m not sure how I would have handled it.

Following my discovery of the lack of adequate care she was receiving and what she was going through, I needed to move her somewhere else, but I was unsure of the destination. Given that I live 1500 miles away, I was completely unfamiliar with the local options. The OurSeniors Team, however, possessed the necessary knowledge and began the process of researching and locating a facility capable of meeting her specific requirements. Bear in mind that she has no ability to walk, speak, or even move a finger. She needs assistance with feeding, bathing, dressing, and all other tasks, which require the help of at least two people at any given time.
The OurSeniors Team was successful in identifying a number of potential locations. We assessed them, and they evaluated my mom. It requires a specialized setting to provide care for someone with stage 5 Parkinson’s disease. My intention was to find a place that would genuinely care for her, as opposed to simply medicating her. I wanted a place where she would receive nutritious meals, regular baths, opportunities to spend time outdoors, companionship, and attentive supervision. This privately owned facility, with its semi-private setup (accommodating only two residents, ensuring that my mom would receive nearly undivided attention), had trained caregivers and medical professionals knowledgeable about her condition. The OurSeniors Team examined the facility, then they brought me to see it and I also examined it. Following that, the facility assessed and screened Mom. She was accepted there.
Mom is now in an ideal setting! I am indebted to OurSeniors, and particularly to Julian Cantillo. Julian’s actions warrant recognition of the highest order. But at the very least, if that is not possible, I can inform anyone in search of assistance for their mother, father, and/or other senior loved ones that Julian from the OurSeniors Team is the person to contact.

We’re referring to the extra coverage obtained through companies like Humana, United Health, or Blue Cross. If you have never reviewed it, it is a great time to begin. You’ll soon be getting lots of Medicare Open Enrollment reminders in the mail and on TV. Open Enrollment happens annually, running from October 15 through December 7. It’s smart to consider all available options before the enrollment period begins.
But why should you think about changing your current policies?
The biggest reason is often because you yourself have changed. Actually, this is almost guaranteed to happen! You likely enrolled in Medicare when you were younger, around age 65. Ideally, you were healthy, needed only basic medical care beyond regular check-ups, and had healthy habits. However, that could have been many years in the past, and your situation may be different now.
By the time you reach 75 or 80 years old, you might require different medical specialists, new prescriptions, medical equipment, or services such as physical therapy. What worked well for a healthy 65-year-old might not be adequate anymore. The creators of Medicare were aware of this possibility and planned accordingly, knowing that some seniors would want to make adjustments each year. Open Enrollment gives an easy chance to make changes.
Please remember- You can make adjustments outside the Open Enrollment timeframe, but only if you are eligible for a SEP (Special Enrollment Period).
To qualify, you’ll need to meet certain criteria, such as moving from your current plan’s area, losing your current coverage, or experiencing a change in Medicaid status. This requirement allows insurance providers to plan for a consistent number of enrollees in the upcoming year.
What steps should you take before Open Enrollment starts?
Spend some time assessing your healthcare needs and evaluating how well your insurance plan is meeting them. How well does the current plan work for you? A structured method simplifies the process of finding the best choice for you.
Start with a list of all your healthcare providers. This includes doctors, labs, hospitals, pharmacies, and services like physical therapy. Does your current plan cover all these services, providers and medications? If it does not, you may want to consider a different plan.
Next, determine how much you actually paid yourself for those services during the past year. “Out-of-pocket” costs include deductibles, co-pays, out-of-network fees, etc. Many seniors are shocked by the expense of these uncovered costs in a plan they had considered to be a great deal. The existing plan might look affordable initially, but it might become an expensive mistake once all the additional costs are factored in.
Vision, hearing, and dental care represent a significant category of uncovered healthcare needs. Individuals who initially enrolled in Original Medicare alongside a Part D Prescription Drug plan most likely lack coverage for vision or dental services. Conversely, “Advantage plans” often include some form of vision and dental coverage. This additional coverage could potentially encourage you to switch over to an Advantage plan. At best, these advertisements generate confusion. At worst, they have the potential to be deceptive. They might employ appealing phrases like “absolutely no additional premiums,” while omitting any mention of limitations on coverage or provider options. Unfortunately, we may someday be faced with a situation in which a loved one no longer has capacity, and we need to step in to protect our loved one from himself or herself or from someone else taking advantage of your loved one. Hopefully, your loved one has engaged in estate planning including a Durable Power of Attorney, Health Care Surrogate, and Preneed Guardian. However, many individuals keep putting off preparing those documents until it is too late. In that situation, a Guardianship of the Person and/or Property becomes necessary. In some instances, the situation may be urgent, and an Emergency Temporary Guardianship may be the only way to protect your loved one.
1) Understand the Process
Emergency Temporary Guardianship is intended for a situation in which one can’t wait for permanent guardianship. Emergency Temporary Guardianship allows the guardian to handle the individual’s personal, financial, and/or medical issues while the permanent guardianship is being processed. Your duties are specifically determined by the Court’s Letters of Emergency Temporary Guardianship and focus on what exactly the alleged incapacitated person needs during that temporary period. At the same time an Emergency Temporary Guardianship is sought, a permanent Guardianship is also sought.
In order to qualify for an Emergency Guardianship, the proposed Emergency Guardian must show that the alleged incapacitated person’s property and/or person are at immediate and serious risk. The Court must find that there is imminent danger of physical or mental harm, or that the person’s property is at risk of being wasted, lost, or misappropriated. The Court appoints an attorney to represent the alleged incapacitated person to ensure the due process rights of the alleged incapacitated person are protected.
2) Know Your Rights and Responsibilities
If you are willing and able to serve as a Temporary Emergency Guardian, you must be able to handle the responsibilities included in the Order of Emergency Temporary Guardianship. You are required to file with the Court an initial plan outlining how you plan on caring for the alleged incapacitated person. In addition, you would be required to file an initial inventory of assets and a final accounting once the Temporary Emergency Guardianship ends, and the permanent Guardianship begins.

The Temporary Emergency Guardianship is in place for up to 90 days. Either before or during the period of the Emergency Temporary Guardianship, the Court appoints an Examining Committee made up of three individuals from a list of approved professionals in that particular judicial circuit. At least one of the members of the Examining Committee must be a medical doctor with the other members being individuals with a great deal of experience dealing with incapacitated persons such as registered nurses, nurse practitioners, psychologists, and professional guardians.
3) Learn How to Protect Elderly Relatives
Emergency Temporary Guardianship can be instrumental in allowing the Guardians to make major care decisions, including:
living arrangements
medical care
financial considerations (including bill payment)
record-keeping
end-of-life decisions
In addition, if someone else files for guardianship of your loved one, you have the right to object to that person. The Court will always choose a guardian based on the person who is best able to fulfill the requirements of a guardianship.

Don White, a native of Daytona Beach, graduated from Mainland High School in 1969, then went to Notre Dame on a four-year Army ROTC scholarship where he saw snow for the first time his freshman year and made a big deal out of it…much to the amusement of classmates. “It may sound corny to some, but ours is a love that will truly never die” says Don. Pretty crazy considering that one of my first impressions of my beloved was “This chick (inappropriate word today, I know, but not for my 24-year-old male brain at that time) is really weird.” More than fifty years later and pushing fifty years of marriage, the whole thing still seems crazy. But that’s what you get when you have the right one. And she was definitely the right one, still the best thing in my life, the love of my life…as I like to call her. I had spotted her in traffic on several occasions on our way home when we were both young, in the Army and stationed at Ft. Carson, Colorado. I stood there jabbering away for about 45 minutes, telling her how I had seen her in traffic multiple times. And then it started to rain and I kept jabbering until she said something about me getting all wet. So…I invited her up to my apartment. To this day she acclaims, “Oh, I was so naïve!” Yes, she probably was but what a good thing because here we are, more than fifty years and growing old together. The common definition of a scammer is a person who commits fraud or participates in a dishonest scheme. The legal definition of a scammer is someone who intentionally deceives others to gain money or property. Rarely does the average citizen envision scamming as a business enterprise. In reality, when you look at the dark web it resembles a department store bulletin board chuck-full of bits and pieces of personal information on sale for a fee. Types of data cybercriminals sell include social security, driver license, and credit and debit card numbers. According to a June 22, 2024 blog by Reza Rafati “Types of Data Cybercriminals Sell on the Dark Web (https://threatintelligencelab.com/blog/types-of-data-cybercriminals-sell-on-the-dark-web/) discusses in some detail how the dark web is a bustling marketplace for purloined data.
Pulling this info theft selling thread even further, according to a December 6, 2017 blog by Brian Stack “Here’s How Much Your Personal Information is Selling for on the Dark Web” (https://www.experian.com/blogs/ask-experian/how-much-your-information-is-selling-for-on-the-dark-web/), the 10 most common pieces of information sold on the dark web includes: social security numbers for $1.00, on-line payment services login info $20- $200, Credit / Debit Card info $5.00-$110, Driver’s License info $20.00, Loyalty Accounts $20.00, General Non-Financial Institution login info $1.00, Diplomas $100-$400, Passports $1000 -$2000, Subscription Services $1.00-$10.00, Medical Records $1.00-$1000.
This blog goes on to mention that there are three main ways that personal information is bought and sold on the dark web.
Purchases can be a one-off acquisition

Purchases can be bought in bundles – often termed “premium packaging” which often include various types of bundled info.
According to a 2020 study, (quora.com/how-much-money-is-made-through-the-darknet-dark-web), it is estimated that the annual revenue generated from these markets could be in the range of 500m to 1 billion.
What drives the cost of personal information on the dark web?
Similar to all standard business models, both supply and demand play a large role in the cost of personal data.
How is Data Valuated?
High Value Data: Credit card details, online banking logins, passport information, social security numbers
Medium Value Data: Email addresses, phone numbers, social media logins
Low Value Data: Basic personal details like name and address (unless combined with other sensitive information)
According to a Knowb4.com Security Awareness Training Blog by Stu Sjouwerman (https://blog.knowbe4.com/1170-is-how-much-youre-worth-on-the-dark-web), the dark web market price index released by the independent VPN review site ‘Top10VPN” alleges that a person’s entire online identity (full package) can be purchased for approximately $1,170 – essentially since enough of our relevant information is already out there. The blog goes on to mention that a full package includes: basic proof of identity, credit and debit accounts, online banking data, login info for everything from your bank and social media accounts to store reward data.
Two dozen preventative strategies to keep your personal information secure might include:
Keeping a watchful eye on your credit reports
Failing to dispute erroneous information in your credit report
Placing fraud alerts and credit freezes on credit reports when fraudulent activity is uncovered
Closing accounts that have been compromised
Searching for the “S” or closed lock symbol on web addresses
Resisting foolishly opening suspicious links
Drafting strong passwords
Modifying passwords on a regular basis
Refraining from automatically storing and saving passwords for future speedy access
